An Erath County grand jury on Thursday indicted a man accused of sexually assaulting a female in August 2026.
Sixty-six-year-old Barney Ross Billue Sr. was indicted for sexual assault (enhanced), a first degree felony.
He is being held at the Erath County Jail on a $100,000 bond.
The following narrative is from the official complaint obtained by Beneath the Surface News.
It begins by stating that an investigator with the Erath County Sheriff’s Office interviewed the victim’s family members while the victim was having a S.A.N.E. exam.
The family told investigators the victim sent a text message to another family member who shared it with the investigator.
"I was asleep when (Billue) asked to come lay with me let him and went back to sleep but woke up with him touching me between my legs and kissing my hips,” the text states.
The family member told the investigator she immediately picked up the victim and took her to her residence.
They then went to Texas Harris Health Hospital in Burleson where a S.A.N.E. exam was completed.
Investigators then interviewed the victim later that afternoon.
“She stated she was woken up by Billue asking her if he could lay with her and she had told him yes and went back to sleep,” the complaint states.
“(The victim) was then woken up again and Billue's head was between her legs performing ‘oral’ on her.
“Victim was then able to kick him off and ran to the bathroom with her phone and began contacting family to come pick her up from the residence.
“Victim confirmed that the acts were being performed without her consent.”
When Billue was interviewed, he reportedly told investigators that “he kissed her shoulder few times while in bed with her” and admitted to penetrating her with his tongue, the complaint states.
