Erath County grand jury indicts couple after child tests positive for methamphetamine.

An Erath County grand jury on Thursday indicted a man and a woman for the state jail felony offense of endangering a child.
The child’s mother, 21-year-old Madisen Comstock, and 38-year-old David Alvarez are accused of using methamphetamine in the presence of the child.
A CPS investigation later revealed that the child tested positive for the substance in its system.
Alvarez has a lengthy criminal history dating back to 2005 when he was arrested for threatening assault. He has also been arrested five times for driving while intoxicated.
Alvarez faces a more recent charge of assault causing bodily injury stemming from an incident that happened in June.
Comstock was arrested in February of 2022 for public intoxication.
Others indicted include:
• Carlos Alberto Benites for manufacture/delivery of a controlled substance, a first-degree felony.
• Danny Duarte for driving while intoxicated (third or more offense), a third-degree felony.
• Hayes Loyd Fuller for possession of a substance (enhanced), a state jail felony, and theft (with previous convictions), a state jail felony.
